Beta Program Participation Agreement
This Beta Program Participation Agreement ('Agreement') is entered into by and between Benchmark Email ('Company'), and you, the Beta participant ('Participant').
1. Purpose
The purpose of this Agreement is to set forth the terms and conditions under which the Participant will use and evaluate the beta version of the Company’s product ('Product') and provide feedback.
2. Term
This Agreement is effective from the date signed and will continue until the earlier of: 1) The public launch of the Product. 2) Termination by either party with written notice.
3. Incentives
The Company agrees to provide the Participant with the following incentive(s) for their participation in the beta program:
- Free use of the Product during the Term of this agreement
- $50 Amazon gift card upon completion of participation requirements (Section 4)
- Discounts on the Product after launch (30% off for 6 months).
4. Participation Requirements
The Participant should actively use the Product and provide feedback as follows:
- Upload at least 250 contacts
- Design and send an email to 250 or more contacts
- Provide feedback via survey upon completion
5. Compliance with Terms of Use
The Participant agrees to comply with the Company’s Terms of Use, which govern the use of the Product. The Terms of Use are incorporated into this Agreement by reference, including our Anti-Spam Policy
6. Restrictions
The Participant shall not:
1. Reverse engineer, decompile, or disassemble the Product.
2. Copy, distribute, or sublicense the Product.
3. Disclose or reveal any information related to the branding, creative assets, or user interface of the beta software platform, including its design, or visual elements.
7. Termination
- Either party may terminate this Agreement upon written notice.
- Upon termination, the Participant must cease all use of the Product and destroy any copies or materials provided by the Company.
